The recently enacted changes impact commercial driver license holders, including fire fighter restricted Class A and Class B driver license holders and Class C license holders, with a HazMat endorsement (except those with an ambulatory endorsement) are subject to a one-year license disqualification for a first conviction. In addition to a DUI involving injury or driving with excessive BAC causing injury in any motor vehicle; 0.04% BAC or greater while operating a commercial motor vehicle; 0.04% BAC or greater while operating a CMV causing injury; Causing a fatality through the negligent operation of a CMV; Refusing to submit to, or failing to complete a chemical test(s); Leaving the scene of an accident while driving any vehicle; and using any vehicle to commit a felony.
STARTING SEPTEMBER 20, 2005:
You are disqualified from having a special CDL or any CDL licensing document if convicted of driving with, or causing injury because of, a blood alcohol content of 0.04% or higher in a commercial vehicle.
A three-year sanction will be taken for a first conviction of any of the violations listed above (one year/lifetime sanctions) that occurs while transporting a hazardous material in a commercial motor vehicle and for any of the following offenses that occur while transporting a hazardous material: Any felony when a motor vehicle is used. Driving under the influence of alcohol or drugs, excess blood alcohol concentration (BAC) while driving, or speed contest. Auto theft.
A lifetime sanction will be taken for a first conviction of using a commercial motor vehicle in the commission of a felony that involves manufacturing, distributing, dispensing, or possession of a controlled substance.
The department keeps a public record of all your traffic convictions and accidents for 36 months or longer. A traffic conviction for driving unsafely counts as one point. Any accident you contributed to or were responsible or at fault for, is normally counted as one points.
If you are convicted of reckless driving, of driving under the influence of alcohol and/or drugs, or of hit-and-run driving, you are charged two points. A violation received in a commercial vehicle carries one and one-half times the point count.
A Class A or B driver who does not have a special certification or an endorsement may be allowed two additional points before being considered a negligent operator. If you get too many points, you lose your privilege to drive.
You are considered a negligent operation of a commercial motor vehicle when your driving record shows the following point counts: 4 points in 12 months 6 points in 24 months 8 points in 36 months You may be entitled to a higher point count (6,8, or 10 points) if you request and appear for a hearing and if 4, 6, or 8 points were not obtained In a Class C vehicle.
